Abstact

The badget in evidence process within the scope of Administrative law , generally differs from private law ,where the administration is in strong status than the individual ,because it protects by documents , So load of evidence to deviation off power from individual side ,to wards administration , faces these difficulties ,which demands from administrative judge to holds positive role to assist the individual to improve his case . As the evidence means are not defined by administrative law so ,it wants toreturn to civil evidence law which related means , but this not permitte multiplicity of evidence meaus due to deviation of power , becausead ministrative court has authority of abstraction it because of difficulity of evidence of defect of powe deviation which can not suppose it , but prove it cvith available evidence means . So , we discuss the subject due to its importance and then we divided it into two chapter , first is discussed the load of evidence of defects of deviation of powe ,the second studied the evidence means of defect of deviation of power .
